Rubbish Bartender Terms and Conditions
1. INTRODUCTION
These are the rules for the Discarded Spirits UK “World’s Most Rubbish Bartender” promotion.
These terms and conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the terms and conditions.
By participating, all entrants will be deemed to have accepted and be bound by the terms and conditions. If applicable, the winner’s guest must also comply with these rules. Please retain a copy for your information.
2. PROMOTER

3. ELIGIBILITY
This promotion is only open to employees of on-trade licenced premises residing in the UK aged 18 years old or over (at their date of entry), excluding employees and their immediate families of the Promoter (or, if not the Promoter, the prize provider), its subsidiaries, other group companies or agents, or anyone else professionally connected with this promotion. Proof of employment / employers’ consent may be requested.
The Promoter may verify any details of any entrant, the winner or the winner’s guest.
4. LIMIT ON ENTRIES
There is a limit of one entry per person. Anyone trying to circumvent this rule will be disqualified from this promotion and any prize award will be void. Entries (bulk or otherwise) made from trade, consumer groups or third parties will not be accepted.
Each entrant is limited to winning one prize per promotion.
5. SOCIAL MEDIA
If this promotion is run on social media, internet access will be required, and entrants must have an active Facebook, Twitter, or Instagram account. If you do not have an account you will need to create one to participate. You will require an active email address to do this.
Your use of Facebook, Twitter, or Instagram to enter this promotion is subject to the relevant platform’s terms and conditions.
Entrants acknowledge that any promotion run via a social media channel is in no way sponsored, endorsed, or administered by, or associated with, that social media channel. By entering, entrants agree to release that social media channel from all liability in connection with the promotion. Entrants also understand that any personal details they submit to enter a promotion or claim a prize are provided to the Promoter and not to that social media channel.
6. PROMOTIONAL PERIOD
The promotion will run from 09:00 29/07/2022 to 17:00 24/08/2022 (GMT UK time).
Any entries received before the start date or after the closing date (for whatever reason) will be invalid.
7. HOW TO ENTER
To enter, fill out the entry form with your details and idea for a cocktail made using one of the spirits from the Discarded range on the promotional website (https://www.discardedspirits.com/content/worlds-most-rubbish-bartender-competition/).
Entries will be judged on the following criteria:
- Your use and knowledge of the Discarded Spirits Co. range.
- Your zero-waste ingredient(s) and the sustainability story behind them. How your drink tastes.
- The beauty is in the details, e.g. how far did you take the zero-waste approach in your drink?
- The theatre of your presentation.
8. GENERAL RULES ON ENTRY
Incomplete, incorrect, illegible, inaudible, misdirected, lost, damaged, late, or otherwise deficient entries will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.
Your entry will be deemed invalid and disqualified if it:
- contains unlawful, defamatory, discriminatory, malicious, indecent, or other inappropriate content;
- includes the names or images of any individual without their express permission;
- in the reasonable opinion of the Promoter, causes any widespread or serious offence;
- contains content deemed socially irresponsible including the promotion of excessive consumption of alcohol;
- features or refers to children;
- made by an entrant using a false name; or
- is made on someone else’s behalf.
If entry is through a promotional website, you are required to follow any other specific instructions on the promotional website.
Internet service providers’ fees may apply when accessing the internet. By using the promotional website, you also agree to the website’s terms and conditions.
9. PRIZE
The entrants that in the opinion of the judges submitted one of the top 10 entries as judged on the criteria set out in clause 7 (top 10 finalist) will each win an invitation to attend the live final event where the entrants will make their cocktail for an independent panel of judges who will taste them and decide from the same criteria set out in clause 7 and considering the final appearance and taste of the cocktail which entrant is the overall winner and will be crowned by them the “World’s Most Rubbish Bartender” (top 10 finalist prize).
At the live final event the overall winner and the “World’s Most Rubbish Bartender” will be the entrant who in the opinion of the judges submitted the best / overall winning entry, as judged on the criteria set out clause 7 and considering the final appearance and taste of the cocktail and will win the main prize.
The main prize is a 3-day hosted trip to Cornwall to be taken 25 - 29 April 2023– winner and winner’s one chosen guest will be accompanied by the Discarded UK and Global Brand Ambassadors and enjoy 3 days of curated activities.
3 x runners-up will also be selected by the judges to win the runners-up prize. The runners-up prize is a day out in London to be taken October / November 2022 – runners-up will be accompanied by the Discarded UK and Global Brand Ambassadors and enjoy a day of curated activities and an overnight stay in London.
Top 10 finalist prize / live final event attendance
Invitation is for the top 10 finalists to attend the live final event in London on 30 August 2022. If a top 10 finalist can’t attend the live final event on this date or has been found to be in breach of these rules (Promoter’s decision on this is final) then the top 10 finalist will be disqualified, and Promoter will select an alternative top 10 finalist to take their place.
Promoter will book all transport and accommodation. Transport arrangements are at the sole discretion of the Promoter. Transport will be by rail only, minimum 2nd class. And accommodation will be 3* minimum.
The main prize is a 3-day hosted trip to Cornwall taking place from 25 – 29 April 2023. Winner and winner’s one chosen guest will travel from home to London by rail on 25 April 2021 and stay overnight in London. They will be accompanied by the Discarded UK and Global Brand Ambassadors and enjoy 3 days of curated activities 26 – 28 April 2023, before returning home by train on 29 April 2023.
Promoter will book all transport and accommodation and meal reservations. Transport and meal arrangements are at the sole discretion of the Promoter. Transport will be by rail only, minimum 2nd class. And accommodation will be 3* minimum. Breakfast, lunch, and dinner included – booked and paid for at Promoter’s sole discretion.
The Promoter will not be liable for any loss or damage suffered by any prize winner or guest that arises out of their failure to arrive at any prize destination or return home.
The Promoter has no obligation to substitute an alternative prize, cash equivalent or other compensation where a prize winner or guest is unable to travel to any prize destination or fails to redeem the prize for any reason.
Runners-up prize
The runners-up prize is a day out in London – runners-up will be accompanied by the Discarded UK and Global Brand Ambassadors and enjoy a day of curated activities and an overnight stay in London. Dates for the trip will be based on the collective availability of the runners-up and Discarded UK and Global Brand Ambassadors but the runners up prize must be taken during October / November 2022 and for dinner to be at Silo London (dependant on availability),
Promoter will book all transport and accommodation and dinner reservations. Transport and dinner arrangements are at the sole discretion of the Promoter. Transport will be by rail only, minimum 2nd class. And accommodation will be 3* minimum. Breakfast, lunch, and dinner included – booked and paid for at Promoter’s sole discretion.

10. GENERAL RULES ON PRIZES
The top 10 finalist prize must be claimed on 30 August 2022. If the top 10 finalist prize is not claimed by this date, the winner will have no entitlement to the prize.
The main prize must be claimed on 25-29 April 2023. And the runners-up prize must be claimed during October / November 2022. If either the main prize or runners-up prize is not claimed on these dates, the winner / runners-up will have no entitlement to the prize.
The Promoter will not be liable for any prizes which are lost, delayed, or damaged when in transit to the winner.
Where prizes are provided by third parties, the prize may be subject to the terms and conditions of that third party.
The Promoter may substitute any prize (or an individual aspect of a prize) for an alternative of equal or greater value where it deems it strictly necessary due to events outside its reasonable control.
Winners may not transfer the right to accept their prize to another person without the Promoter’s consent.
The Promoter will not offer cash alternatives to any prizes. Prizes are not negotiable.
Where a prize entitles the winner to bring a guest, the guest must be over the age of 18. The winner will remain responsible for the actions of its guest at all times whilst enjoying the prize.
11. WINNER SELECTION
The Promoter’s selection of all winners is final.
All entries will be judged on the criteria set out in clause 7. For the top 10 finalists within 12 working days of the end of the promotion period, by a panel including at least one judge who is independent from the Promoter. And for the overall winner and runners-up, during the live final event, by a panel including at least two judges who are independent from the promoter.
12. WINNER NOTIFICATION
Top 10 finalists will be contacted by phone within by 27 August 2022.
Winners have 12 days to verify their details (name, email address, postal address, and age) to claim the prize. If they do not respond in time another winner will be selected using the same methodology as above. The Promoter may repeat this process as often as is necessary.
Entrants are encouraged to monitor their connections during this time in case they are the winner.
13. PUBLICIITY/NAME RELEASE
All winners to take part in publicity in connection with this promotion and to allow the Promoter to publish their name and location in the prize winners list.
The prize winners’ full names and counties are available by sending a sending a self-addressed envelope to the Promoter within 3 months of the applicable closing date. Please mark the request “FAO: Discarded Spirits Co. – World’s Most Rubbish Bartender”.
Entrants, winners and (if applicable) any guests may be required to participate in photo, recordings, video and/or filming sessions and to all allow the Promoter, without charge, to use these photos, recordings, videos and/or films in any media and in any manner it sees fit.
14. VERIFICATION
The Promoter reserves the right to verify all entries including, but not limited to, asking for address and identity details (which they must provide within 14 days).
The Promoter may:
· refuse to award a prize;
· withdraw prize entitlement;
· refuse further participation in the promotion; and/or
· disqualify the participant,
where there are reasonable grounds to believe the entrant has broken these terms and conditions, won using fraudulent means or otherwise gained unfair advantage.
15. COPYRIGHT
All entries become the property of the Promoter, and none shall be returned.
If the promotion involves the submission of audio, video, text, images, or other content, you must ensure your submission:
(i) is not copied from a third party;
(ii) does not otherwise infringe a third party’s intellectual property rights;
(iii) does not feature any person (living or dead) without their permission; and
(iv) does not contain any defamatory, obscene, offensive, hateful, illegal, or otherwise unsuitable materials.
You will retain any copyright which exists in your submission but, by entering, entrants licence and grant the Promoter an exclusive, royalty free, perpetual, worldwide, irrevocable, and sub-licensable right to use your content for any purpose in any media, without compensation, restriction on use, attribution or liability.
Participants agree not to assert any moral rights in relation to such use.
Participants warrant that the materials contain no third-party materials, are their original works, have not been copied, in whole or in part, from any third party and they have full authority to grant these rights.
16. SOCIAL MEDIA DISCLAIMERS
This promotion is in no way sponsored, endorsed, or administered by, or associated with Facebook, Twitter, or Instagram. By entering the promotion, all participants accept that they have no claim against Facebook, Twitter, or Instagram. By entering the promotion, all participants agree to a complete liability release for Facebook, Twitter, or Instagram.
Numerous factors outside the control of the Promoter may interfere with the operation of Facebook, Twitter, and Instagram. The Promoter does not guarantee continuous, uninterrupted, or secure access to these websites.
17. TAX LIABILITY
(trade only)
Any tax liability arising from receipt of the prize will be the responsibility of the recipient.
18. LIABILITY
If for any reason any aspect of this promotion is not capable of running as planned (including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion), the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries/claims.
If an act, omission, event, or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation. In these circumstances, the Promoter may immediately terminate the promotion without any liability.
Except for any liability which cannot be excluded by law (in which case that liability shall be limited to the minimum allowable by law), the Promoter and its associated agencies and companies will not be liable for any loss (including indirect, special, or consequential loss or loss of profits), expense or damage which is suffered (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize.
19. BRAND PROTECTION
The winner and (if applicable) the winner’s guest must not do anything which could, in the reasonable opinion of the Promoter, bring the Promoter or its brand into disrepute before, during or after this promotion.

20. GENERAL
If any of these clauses are determined to be illegal, invalid, or otherwise unenforceable, then it shall be deleted from these terms and conditions. The remaining clauses shall survive and remain in full force and effect.
These terms and conditions are governed by English law. The Courts of England and Wales will have exclusive jurisdiction.
21. DATA PROTECTION
The Promoter will use the personal details supplied by entrants for the administration of the promotion, which may involve transferring that information to third parties involved in the administration of the promotion (e.g. the Promoter’s marketing agency) and, in the case of winners, the fulfilment of the prize.
The personal details entrants submit must be true and up to date.
The handling of this personal data will be in accordance with the Promoter’s Privacy Policy which can be found at https://www.discardedspirits.com/privacy. By participating in the Promotion, you agree to this use of your personal data.
You can request access to your personal data, or have any inaccuracies rectified, by sending an email to DataProtection@wgrant.com.
If you are required to submit a third party’s personal data to enter the promotion, you must ensure that the person whose details you submit has given their consent for you to provide the Promoter with their personal data.
