Rubbish Bartender Terms and Conditions

1. INTRODUCTION

These are the rules for the Discarded Spirits UK “World’s Most Rubbish Bartender 2023” promotion.

These terms and conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the terms and conditions.

By participating, all entrants will be deemed to have accepted and be bound by the terms and conditions. If applicable, the winner’s guest must also comply with these rules. Please retain a copy for your information.

2. PROMOTER

3. ELIGIBILITY

This promotion is only open to employees of on-trade licenced premises residing in the UK, Denmark, Finland and Norway aged 18 years old or over (at their date of entry), excluding employees and their immediate families of the Promoter (or, if not the Promoter, the prize provider), its subsidiaries, other group companies or agents, or anyone else professionally connected with this promotion. Entrants must seek permission from their employers. Proof of employment and/or employers’ consent may be requested.

The Promoter may verify any details of any entrant, the winner or the winner’s guest. Internet access required. No purchase necessary.

4. LIMIT ON ENTRIES

There is a limit of one entry per person. Anyone trying to circumvent this rule will be disqualified from this promotion and any prize award will be void. Entries (bulk or otherwise) made from syndicates, consumer groups or third parties will not be accepted. If it becomes apparent that a participant is reposting the same content multiple times or using a computer(s) to circumvent this or any other condition by, for example, the use of ‘script’, ‘brute force’ or any other automated means, that person’s entries will be disqualified and any prize award will be void.

5. PROMOTIONAL PERIOD

The UK promotion will run from 09:00 01/06/2023 to 21:00 26/06/2023 (GMT UK time). The Denmark promotion will run from 09:00 01/06/2023 to 21:00 07/07/2023 (CET time). The Finland promotion will run from 09:00 22/05/2023 to 21:00 15/06/2023 (CET time). The Norway promotion will run from 09:00 03/07/2023 to 21:00 03/08/2023 CET UK time). Any entries received before the start date or after the closing date (for whatever reason) will be invalid.

6. HOW TO ENTER

To enter competition, fill out the entry form with your details and submit an idea for a cocktail made using one of the spirits from the Discarded range on the promotional website (www.discardedspirits.com/worldsmostrubbishbartender).

Entries will be judged on the following criteria, weighted in the following way:
Your zero-waste ingredient(s) and the sustainability story behind them - 50%
The beauty is in the details, e.g. how far did you take the zero-waste approach in your drink? – 50%8.

7. GENERAL RULES ON ENTRY

Incomplete, incorrect, illegible, misdirected, lost or otherwise deficient entries will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

Your entry will be deemed invalid and disqualified if it:

  • contains unlawful, defamatory, discriminatory, malicious, indecent, or other inappropriate content; 
  • includes the names or images of any individual without their express permission;
  • in the reasonable opinion of the Promoter, causes any widespread or serious offence;
  • contains content deemed socially irresponsible including the promotion of excessive consumption of alcohol; features or refers to children;
  • made by an entrant using a false name; or
  • is made on someone else’s behalf.

If entry is through a promotional website, you are required to follow any other specific instructions on the promotional website. Internet service providers’ fees may apply when accessing the internet. By using the promotional website, you also agree to the website’s terms and conditions.

8. PRIZE

The entrants that in the opinion of the judges (including at least one judge who is independent from the Promoter) submitted one of the top 6 entries as judged on the criteria set out above (top 6 finalist) in the first round of judging will each win an invitation to attend the Live National Final in each country. 12 finalists selected in the UK, 6 for UK North final and 6 for UK South final.

UK South – London 6 July 2023
Finland – 18 June 2023
Denmark – 11 July 2023
Norway – 8 August 2023

If a top 6 finalist can’t attend the live national final event or has been found to be in breach of these rules (Promoter’s decision on this is final) then the top 6 finalist will be disqualified, and Promoter will select the next highest rated entry to take their place.

The Top 6 finalist’s entry into the National Final will includes transport, meals, and one night’s accommodation. Promoter will book all transport and accommodation and meal reservations. All arrangements are at the sole discretion of the Promoter. Transport will be by rail only, minimum 2nd class. Accommodation will be 3* minimum. Breakfast Lunch, and dinner included – booked and paid for at Promoter’s sole discretion. At each of the National Finals the entrants will make their cocktail for an independent panel of judges who will taste them and decide from the criteria set out below to decide which entrant is the overall national winner. Two winners will be chosen in the UK. The overall winners from each of the National Finals will go on to the Global Final.

Those in the Live National Final will be judged on the following criteria by the judges, weighted in the following way:

  • Your use and knowledge of the Discarded Spirits Co. range – 10%
  • Your zero-waste ingredient(s) and the sustainability story behind them - 30%
  • How your drink tastes - 20%
  • The beauty is in the details, e.g. how far did you take the zero-waste approach in your drink? – 30%
  • The theatre of your presentation – 10%

At each of the live National Final events, the winner will be the entrant who in the opinion of the judges submitted the best overall winning entry, as judged on the criteria set out above and considering the final appearance and taste of the cocktail and will win the main prize of entry into the Global Final.

The winners of the live national finals (UK x2, Finland x1, Norway x1, and Denmark x1) will be invited to the UK for 4 days (28 – 31 August 2023) to compete in the Global Final on 29th and 30th August 2023.

The competitors in the global final will be evaluated by a the judges on the below activities, weighted in the below way:

  • Team Activity One – Scrap Heap Challenge – 20%
  • Team Activity Two – Cocktail Selling Activity – 20%
  • Solo Activity One – Ready Steady Cocktail – 30%
  • Solo Activity Two – Make Me A Drink – 30%

The top three scoring competitors will be eligible to win a Global Final prize.

If a national winner can’t attend the live global final event or has been found to be in breach of these rules (Promoter’s decision on this is final) then the national winner will be disqualified, and Promoter will select the next highest rated entry to take their place.

The National Winners entry into the Global Final will includes transport, and meals.

The length of stay will be from 28th August to 31st August. Promoter will book all transport and accommodation and meal reservations. All arrangements are at the sole discretion of the Promoter. Transport will be by rail only, minimum 2nd class. Accommodation will be 3* minimum Breakfast, lunch, and dinner included – booked and paid for at Promoter’s sole discretion.

The main prize of the Global Final for the top scoring competitor is a 6-day hosted trip to New Orleans to be taken 21 - 27 July 2024 only. The winner will be accompanied by the Discarded UK and Global Brand Ambassadors and enjoy 6 days of curated activities. Includes transport, accommodation and meals (breakfast, lunch, and dinner).

Promoter will book all transport and accommodation and meal reservations.

Flights will be a minimum of Premium Economy and Hotel will be a minimum of 4 star.

Flights will be from a major airport in the winner’s home country to New Orleans. Transfers from their home to the airport, as well as transfers from New Orleans to the hotel, are included. Insurance is included.

All arrangements are at the sole discretion of the Promoter.

Activities include:

  • Entry into Tails of the Cocktail 2024 and all William Grant & Sons associated Events
  • Airboat Swamp Tour
  • Historic Tour of the French Quarter

The second place prize for the Global Final

Is a 2 day trip- for 2 people (winner and one guest 18+) to an ‘eco-hotel’ in the prize winners home country, to be agreed upon with the promoter, to the maximum value of £2000.

An ‘Eco-Hotel’ list for each country will be provided by the promoter for the prize winner to choose from. Includes transport, accommodation and meals. Promoter will book all transport and accommodation and meal reservations. All arrangements are at the sole discretion of the Promoter. Transport will be by rail only, minimum 2nd class. Accommodation will be 3* minimum. Breakfast, lunch, and dinner included – booked and paid for at Promoter’s sole discretion. This prize is to be booked and taken in the 12 months following September 2023.

The third place prize for the Global Final

Is a dinner for two people (winner and one guest 18+) at a Green Michelin Stared Restaurant in the prize winner’s home country. Includes transport.

A Green Michelin Stared Restaurant list for each country will be provided by the promoter for the prize winner to choose from. Promoter will book all transport and meal reservations. All arrangements are at the sole discretion of the Promoter. Transport will be by rail only, minimum 2nd class.

This prize is to be booked and taken in the 12 months following September 2023.

Global Main prize Terms and Conditions

The winner must have a valid passport and have all necessary and relevant visas (if applicable) to travel to the chosen prize destination. Their passport must have an expiry date no less than 6 months following the dates of travel, unless otherwise specified by a pertinent regulation. All passport and visa requirements are the sole responsibility of the winner.

Travel insurance is subject to restrictions and the Terms and Conditions of the insurance provider. It is the responsibility of the winner to meet any additional costs relating to obtaining insurance cover for any pre-existing medical condition and for any additional costs as may be specified where the winner is aged 55 or over.

The winner is responsible for all expenses not expressly stated in these Terms and Conditions as being included as part of the prize.

The Promoter will not be liable for any loss or damage suffered by the prize winner that arises out of their failure to arrive at any prize destination or return home unless the Promoter is liable for any loss or damage. The Promoter has no obligation to substitute an alternative prize, cash equivalent or other compensation where the prize winner is unable to travel to the prize destination or fails to redeem the prize for any reason.

The Promoter will not be liable for any loss or damage suffered by any prize winner or guest that arises out of their failure to arrive at any prize destination or return home.

Global Second Prize Terms and Conditions

The winner is responsible for all expenses not expressly stated in these Terms and Conditions as being included as part of the prize. The Promoter will not be liable for any loss or damage suffered by any prize winner or guest that arises out of their failure to arrive at any prize destination or return home unless the Promoter is liable for any loss or damage.

The Promoter has no obligation to substitute an alternative prize, cash equivalent or other compensation where a prize winner or guest is unable to travel to any prize destination or fails to redeem the prize for any reason.

Global Third Prize Terms and Conditions

The Promoter will not be liable for any loss or damage suffered by the prize winner or guest that arises out of their failure to arrive at any prize destination or return home unless the Promoter is liable for any loss or damage.

The Promoter has no obligation to substitute an alternative prize, cash equivalent or other compensation where a prize winner or guest is unable to travel to any prize destination or fails to redeem the prize for any reason.

Three prizes available to be won in total.

9. GENERAL RULES ON PRIZES

The top 6 national finalist prize must be claimed on the below dates for the below countries:

  • UK North - Glasgow – 1 July 2023
  • UK South – London - 2 July 2023
  • Finland – 18 June 2023
  • Denmark – 8 July 2023
  • Norway – 4 August 2023

If the top 6 finalist prize is not claimed by this date, the winner will have no entitlement to the prize.

The main prize must be taken between the 21-27 July 2024. Runners-up prize must be booked and taken between September 2023 and September 2024. If any prize is not claimed between these dates, the winner / runners-up will have no entitlement to the prize.

The Promoter may substitute any prize (or an individual aspect of a prize) for an alternative of equal or greater value where it deems it strictly necessary due to events outside its reasonable control.

Winners may not transfer the right to accept their prize to another person without the Promoter’s consent.

The Promoter will not offer cash alternatives to any prizes. Prizes are not negotiable.

Where a prize entitles the winner to bring a guest, the guest must be over the age of 18. The winner will remain responsible for the actions of its guest at all times whilst enjoying the prize.

10. WINNER SELECTION

The Promoter’s selection is final and no correspondence will be entered into.

All entries will be judged on the criteria set out above to select the top 6 finalists within 3 working day of the end of the promotion period, by a panel including at least one judge who is independent from the Promoter. For the overall winner and runners-up during the live global final event, finalists will be judged by a panel including at least two judges who are independent from the promoter.

11. FINALIST & WINNER NOTIFICATION

National Finals –

Top 6 national finalists from each country will be contacted by phone call and email within 1 working day following closing of the promotion in their country of entry.

National finalists have 2 days to claim the prize. If they do not respond in time another finalist will be selected using the next highest scoring entry. The Promoter may repeat this process as often as is necessary.

Entrants are encouraged to monitor their connections during this time in case they are a finalist.

Global Finals –

The winner of each National Final will be chosen at the National Finals, using the criteria outlined above. The promoter will contact all Global Finalists via email and phone call by 12th August 2023 to arrange transport and accommodation to London for the Global Final.

The winners of the three Global Final Prizes will be announced at the Global Final on 30th August 2023, using the criteria outlined above.

The promoter will contact the three global prize winners via email and phone call to confirm fulfilment of their prizes by 1st September 2023.

If any finalist or winner can’t attend either final or has been found to be in breach of these rules (Promoter’s decision on this is final) then they will be disqualified, and Promoter will select the next highest rated entry to take their place.

12. PUBLICITY / NAME RELEASE

All winners will be requested to take part in publicity in connection with this promotion and to allow the Promoter to publish their surname and county in the prize winners list.

The global main prize winner’s surname and county of residence is available by sending a sending an email to info@discardedspirits.com to the Promoter within 3 months of the global final. Please mark the request “FAO: Discarded Spirits Co. – World’s Most Rubbish Bartender”. The Promoter reserves the right to refuse such requests. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting info@discardedspirits.com . We may nevertheless disclose the information to the Advertising Standards Authority if required to do so.

Entrants, winners and (if applicable) any guests may be requested to participate in photo, recordings, video and/or filming sessions and to all allow the Promoter, without charge, to use these photos, recordings, videos and/or films in any media and in any manner it sees fit.

13. VERIFICATION

The Promoter reserves the right to verify all entries including, but not limited to, asking for proof of home address and identity details (passport, driving licence or equivalent) which they must provide within 14 days. 

The Promoter may:

  • refuse to award a prize;
  • withdraw prize entitlement;
  • refuse further participation in the promotion; and/or
  • disqualify the participant,

Where there are reasonable grounds to believe the entrant has broken these terms and conditions, won using fraudulent means or otherwise gained unfair advantage.

14. COPYWRIGHT

All entries become the property of the Promoter, and none shall be returned.

If the promotion involves the submission of audio, video, text, images, or other content, you must ensure your submission:

(i) is not copied from a third party;

(ii) does not otherwise infringe a third party’s intellectual property rights;

(iii) does not feature any person (living or dead) without their permission; and

(iv) does not contain any defamatory, obscene, offensive, hateful, illegal, or otherwise unsuitable materials.

You will retain any copyright which exists in your submission but, by entering, entrants licence and grant the Promoter an exclusive, royalty free, perpetual, worldwide, irrevocable, and sub-licensable right to use your content for any purpose in any media, without compensation, restriction on use, attribution or liability. Participants agree not to assert any moral rights in relation to such use.

Participants warrant that the materials contain no third-party materials, are their original works, have not been copied, in whole or in part, from any third party and they have full authority to grant these rights.

15. SOCIAL MEDIA DISCLAIMERS

This promotion is in no way sponsored, endorsed, or administered by, or associated with Facebook, Twitter, or Instagram. By entering the promotion, all participants accept that they have no claim against Facebook, Twitter, or Instagram. By entering the promotion, all participants agree to a complete liability release for Facebook, Twitter, or Instagram.

Numerous factors outside the control of the Promoter may interfere with the operation of Facebook, Twitter, and Instagram. The Promoter does not guarantee continuous, uninterrupted, or secure access to these websites.

16. TAX LIABILITY 

Any tax liability arising from receipt of the prize will be the responsibility of the recipient.

17. LIABILITY

If for any reason any aspect of this promotion is not capable of running as planned (including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion), the Promoter may in its sole discretion cancel, modify or suspend the promotion or invalidate any affected entries.

If an act, omission, event, or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation. In these circumstances, the Promoter may immediately terminate the promotion without any liability.

Except for any liability which cannot be excluded by law (in which case that liability shall be limited to the minimum allowable by law), the Promoter and its associated agencies and companies will not be liable for any loss (including indirect, special, or consequential loss or loss of profits), expense or damage which is suffered (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using a prize. It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion and on prize acceptance. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize

18. BRAND PROTECTION

The winner and (if applicable) the winner’s guest must not do anything which could, in the reasonable opinion of the Promoter, bring the Promoter or its brand into disrepute before, during or after this promotion.

19. GENERAL

If any of these clauses are determined to be illegal, invalid, or otherwise unenforceable, then it shall be deleted The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the promotion.

If any of these clauses are determined to be illegal, invalid, or otherwise unenforceable, then it shall be deleted from these terms and conditions. The remaining clauses shall survive and remain in full force and effect.

These terms and conditions are governed by English law. The Courts of England and Wales will have exclusive jurisdiction unless you live in another part of the UK, in which case your local courts will have jurisdiction.

20. DATA PROTECTION

The Promoter will use the personal details supplied by entrants for the administration of the promotion, which may involve transferring that information to third parties involved in the administration of the promotion (e.g. the Promoter’s marketing agency) and, in the case of winners, the fulfilment of the prize.

The personal details entrants submit must be true and up to date.

The handling of this personal data will be in accordance with the Promoter’s Privacy Policy which can be found at https://www.discardedspirits.com/privacy. By participating in the Promotion, you agree to this use of your personal data.

If you are required to submit a third party’s personal data to enter the promotion, you must ensure that the person whose details you submit has given their consent for you to provide the Promoter with their personal data.
